The German version of these Terms and Conditions is legally binding.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 1 Scope and provider<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) These General Terms and Conditions (GTC) apply to all contracts you conclude with us via the online shop at bezugla.de and for our counselling services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) Your contractual partner is:<br>Zentrum f\u00fcr Pr\u00e4vention und Ern\u00e4hrung<br>Owner: Ihor Bezuhlyi<br>Joachim-Karnatz-Allee 47, 10557 Berlin, Germany<br>Phone: +49 175 7495618, email: info@bezugla.de<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (\u00a7 13 German Civil Code, BGB). Deviating terms of the customer do not apply unless we expressly agree to them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 2 Our offer<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) We offer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n\n\n<li>dietary supplements and home lab tests (online shop),<\/li>\n\n\n\n<li>nutrition counselling, InBody body composition analysis and prevention programmes \u2013 in person in Berlin or online via video or phone (counselling services).<\/li>\n\n\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">(2) Our counselling services serve prevention and nutrition counselling. They are not medical treatment and do not replace a medical diagnosis or therapy. If you have health complaints, please consult a doctor.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 3 Conclusion of contract in the online shop<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) The presentation of products in the online shop is not a legally binding offer but an invitation to place an order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) You can add products to the cart and enter your details as well as the shipping and payment method during checkout. Before completing the order, all details are shown to you in an overview; you can correct input errors there using the usual browser and keyboard functions or via \u201cBack to cart\u201d. By clicking the \u201cPlace order with obligation to pay\u201d button, you submit a binding offer to purchase the goods in your cart.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) Immediately after submitting your order you will receive an automatic email confirming receipt of your order. The contract is concluded when we accept your order by email (order confirmation) or ship the goods to you \u2013 whichever happens first. If you choose PayPal, Klarna, credit card, Apple Pay or Pay by Bank, the contract is concluded as soon as the payment process has been successfully completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(4) We only sell goods in quantities customary for households.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 4 Conclusion of contract for counselling services<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) You can request appointments and programmes by phone, email, contact form or messenger. The contract is concluded when we confirm the appointment or your participation in the programme in text form (e.g. by email or messenger).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) If you cannot attend an agreed appointment, please cancel or reschedule it at least 24 hours in advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) Counselling requires your cooperation and complete, truthful information (e.g. about pre-existing conditions, medication and allergies). We do not owe any particular health outcome, such as a specific weight loss.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 5 Contract language and storage of the contract text<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) The contract language is German. Translations of these GTC are for information only; the German version prevails.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) We store the contract text. You will receive the order details and these GTC with the order confirmation by email. You can also view and print these GTC on this page at any time. If you have created a customer account, you can view your orders there.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 6 Prices and shipping costs<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) All prices are final prices. In accordance with \u00a7 19 UStG (German small business regulation), no VAT is charged or shown.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) Shipping costs are charged in addition to the prices unless stated otherwise. The amount depends on the destination country and is shown on the \u201cShipping and payment conditions\u201d page and during checkout. Within Germany, shipping is free for orders of 50.00 \u20ac or more; to Austria, for orders of 89.00 \u20ac or more.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) For deliveries to countries outside the European Union, customs duties, import taxes and fees may apply, which are payable by the recipient.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 7 Delivery<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) We deliver to Germany, to the member states of the European Union and to the United Kingdom, the USA and Canada. All orders are shipped with DHL.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) Delivery times are shown on each product page and on the \u201cShipping and payment conditions\u201d page. For payment by bank transfer (prepayment), the delivery period begins on the day after you instruct your bank to make the payment; for all other payment methods, it begins on the day after the contract is concluded. If the last day of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) If an ordered product is unavailable because our supplier has failed to deliver to us through no fault of our own, we will inform you without delay and refund any payments already made without delay.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 8 Payment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) You can pay with PayPal, Klarna, credit card (Visa, Mastercard), Apple Pay, Pay by Bank or by bank transfer (prepayment). Payments are processed by the payment service provider Mollie B.V., Amsterdam. The payment methods available in each case are shown during checkout.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) The purchase price is due when the contract is concluded. For prepayment, you will receive our bank details with the order confirmation; we ship the goods once payment has been received.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) For payments via Klarna, the terms of Klarna Bank AB (publ), shown to you during checkout, also apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(4) Unless otherwise agreed, counselling services must be paid before the appointment or before the programme starts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 9 Retention of title<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The goods delivered remain our property until paid in full.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 10 Right of withdrawal<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Consumers have a statutory right of withdrawal. Details, in particular on deadlines, consequences and exceptions, can be found in our <a href=\"https:\/\/bezugla.de\/en\/cancellation-policy\/\">withdrawal policy<\/a>; a <a href=\"https:\/\/bezugla.de\/en\/sample-withdrawal-form\/\">model withdrawal form<\/a> is available to you.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 11 Warranty and transport damage<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) The statutory rights for defects apply.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) If goods are delivered with obvious transport damage, please report the damage to the carrier as soon as possible and inform us. Failure to do so has no effect on your statutory rights; it only helps us assert our own claims against the carrier.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 12 Liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) We are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or by gross negligence, under the German Product Liability Act and to the extent of any guarantee we have given.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) In the event of a slightly negligent breach of an essential contractual obligation (cardinal obligation), our liability is limited to the foreseeable damage typical for this type of contract. Essential contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(3) Otherwise, liability for damage caused by slight negligence is excluded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(4) The above limitations of liability also apply in favour of our vicarious agents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 13 Notes on dietary supplements and lab tests<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) Dietary supplements are not a substitute for a balanced and varied diet and a healthy lifestyle. Please follow the recommended intake and the notes on the packaging. Pregnant or breastfeeding women, children and people taking medication should consult a doctor before use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(2) Lab tests are analysed by the respective laboratory. The results do not replace a medical diagnosis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 14 Dispute resolution<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have any questions or complaints, you can reach us at any time at info@bezugla.de.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00a7 15 Final provisions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
