2. General information on data processing<\/h2>\n\n\n\n

Personal data is any information relating to an identified or identifiable natural person (Art. 4(1) GDPR). We only process personal data to the extent necessary to provide a functional website, to perform contracts, to comply with legal obligations or on the basis of your consent.<\/p>\n\n\n\n

    3. Hosting and content delivery<\/h2>\n\n\n\n

    Hosting<\/h3>\n\n\n\n

    Our website is hosted by HOSTiQ (sole trader Mykola Skurykhin), Lviv, Ukraine. All data arising from visits to the website, orders or forms is stored on the hosting provider\u2019s servers. The hosting provider processes the data solely on our behalf and in accordance with our instructions (Art. 28 GDPR).<\/p>\n\n\n\n

    Ukraine is a third country outside the EU for which there is no adequacy decision of the European Commission. The transfer is based on the European Commission\u2019s standard contractual clauses (Art. 46(2)(c) GDPR), which we have agreed with the hosting provider. You can request a copy using the contact details above.<\/p>\n\n\n\n

    Legal basis: Art. 6(1)(b) and (f) GDPR (secure and efficient provision of our online services).<\/p>\n\n\n\n

    Cloudflare<\/h3>\n\n\n\n

    To protect the website and deliver it faster, we use the content delivery network of Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. Traffic between your browser and our website is routed through Cloudflare servers; in particular, your IP address is processed. Cloudflare is certified under the EU-US Data Privacy Framework (adequacy decision under Art. 45 GDPR); in addition, we have concluded a data processing agreement including standard contractual clauses.<\/p>\n\n\n\n

    Legal basis: Art. 6(1)(f) GDPR (protection against attacks, stability and loading speed of the website).<\/p>\n\n\n\n

    4. Server log files<\/h2>\n\n\n\n

    Each time our website is accessed, the following data is automatically stored in server log files: IP address, date and time of access, page or file requested, amount of data transferred, referrer URL, browser type and version, operating system.<\/p>\n\n\n\n

    This data is used to ensure trouble-free operation and the security of our systems. It is not combined with other data sources. The log files are deleted as soon as they are no longer required for these purposes, unless they are needed to investigate a specific security incident.<\/p>\n\n\n\n

    5. Cookies and consent management<\/h2>\n\n\n\n

    Our website uses cookies and similar technologies (e.g. local storage). We use technically necessary cookies \u2013 for example for the shopping cart, checkout, customer account, language selection and storing your cookie settings \u2013 on the basis of \u00a7 25(2) no. 2 TDDDG and Art. 6(1)(b) or (f) GDPR.<\/p>\n\n\n\n

    We only use all other cookies (statistics, marketing) if you have consented via our cookie banner (\u00a7 25(1) TDDDG, Art. 6(1)(a) GDPR); for the cookieless signals of Google Consent Mode, see section 13. We manage consents with the WordPress plugin \u201cPressidium Cookie Consent\u201d, which stores your choice in a cookie in your browser; no data is passed on to third parties.<\/p>\n\n\n\n

    You can withdraw or change your consent at any time with effect for the future by reopening the cookie settings (link in the footer).<\/p>\n\n\n\n

    Order attribution (WooCommerce)<\/h3>\n\n\n\n

    Our shop system WooCommerce stores in cookies (named \u201csbjs_\u2026\u201d), for the duration of the session or up to six months, the source through which you reached our website (e.g. search engine, advert, direct visit). This information is only transmitted to our shop together with an order and helps us understand which channels lead to orders. It is not passed on to third parties. Legal basis: Art. 6(1)(f) GDPR.<\/p>\n\n\n\n

    6. Online shop, orders and customer account<\/h2>\n\n\n\n

    When you order from our shop, we process the data required to perform the contract: name, billing and delivery address, email address, telephone number if provided, products ordered, payment method and payment status. Mandatory fields are marked as such; without this information the contract cannot be concluded.<\/p>\n\n\n\n

    You can order as a guest or create a customer account. In the customer account we store your master data, addresses and order history until you ask us to delete the account.<\/p>\n\n\n\n

    Legal bases: Art. 6(1)(b) GDPR (performance of contract) and Art. 6(1)(c) GDPR (retention of invoices and accounting records under \u00a7 147 AO and \u00a7 257 HGB).<\/p>\n\n\n\n

    7. Payment processing<\/h2>\n\n\n\n

    Payments in our shop are processed by the payment service provider Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, the Netherlands. For this purpose, Mollie receives the data required for the payment (in particular name, billing address, email address, order amount, order number and the payment details of the selected payment method). Your full card or account details are not stored on our website.<\/p>\n\n\n\n

    Depending on the payment method selected, your data is also transmitted to the respective provider, which processes it under its own responsibility:<\/p>\n\n\n\n

      Legal bases: Art. 6(1)(b) GDPR (performance of contract) and Art. 6(1)(f) GDPR (fraud prevention).<\/p>\n\n\n\n

      8. Shipping<\/h2>\n\n\n\n

      To deliver your order, we pass your name and delivery address to DHL Paket GmbH, Str\u00e4\u00dfchensweg 10, 53113 Bonn, Germany (Art. 6(1)(b) GDPR). For deliveries outside the EU, DHL also receives the information required for customs clearance (contents and value of the shipment).<\/p>\n\n\n\n

      We only transmit your email address or telephone number to DHL if you have expressly consented to this during checkout so that DHL can inform you about the delivery time (Art. 6(1)(a) GDPR). You can withdraw this consent at any time.<\/p>\n\n\n\n

      9. Lab tests (Medivere)<\/h2>\n\n\n\n

      The lab tests offered in our shop (stool and saliva tests) are provided by Medivere GmbH, Germany, and analysed in its partner laboratory (including GANZIMMUN Diagnostics GmbH, Mainz). We only ship the test kit. You send the sample directly to the laboratory; registration, analysis and delivery of the results are carried out by Medivere or the laboratory under their own data protection responsibility. We only receive your results if you provide them to us yourself, for example as part of a consultation.<\/p>\n\n\n\n

      10. Contacting us<\/h2>\n\n\n\n

      If you contact us via the contact form, email, phone or messenger, we process your details (e.g. name, email address, telephone number, content of your message) to handle your request.<\/p>\n\n\n\n

      • Contact form:<\/strong> The form data is processed on our server, forwarded to us by email and, as a safeguard, also stored in our website\u2019s database. You receive an automatic confirmation of receipt at the email address you provided. We delete stored enquiries once they have been fully dealt with, at the latest after six months. To protect against spam, form entries are automatically checked for typical spam characteristics; your IP address may be compared with public block lists.<\/li>\n\n\n\n
      • Email:<\/strong> Our mailboxes are operated via Google Workspace of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We have a data processing agreement with Google; to the extent data is transferred to Google LLC in the USA, Google is certified under the EU-US Data Privacy Framework.<\/li>\n\n\n\n
      • WhatsApp, Viber, Telegram:<\/strong> If you write to us via a messenger, the privacy policy of the respective provider also applies (WhatsApp Ireland Limited; Viber Media S.\u00e0 r.l., Luxembourg; Telegram FZ-LLC, Dubai). These providers may also process metadata and contact data outside the EU. Please do not send us sensitive health data via messenger; please use a personal consultation for this.<\/li>\n\n\n<\/ul>\n\n\n\n

        Legal bases: Art. 6(1)(b) GDPR if your request relates to a contract, otherwise Art. 6(1)(f) GDPR (answering enquiries). We delete the data once your request has been fully dealt with and no statutory retention obligations apply.<\/p>\n\n\n\n

        11. Nutrition counselling and health data<\/h2>\n\n\n\n

        We do not collect any health data via our website; such information is provided exclusively in the personal counselling session.<\/p>\n\n\n\n

        As part of our nutrition counselling, prevention programmes and InBody 270 body composition analysis, we process not only your contact details but also health data, e.g. information on complaints, eating habits, body composition measurements and lab results you provide. This data belongs to the special categories of personal data under Art. 9 GDPR.<\/p>\n\n\n\n

        We process this data solely to carry out the counselling and only with your explicit consent (Art. 9(2)(a) GDPR), which we obtain before the counselling begins. You can withdraw your consent at any time with effect for the future. We keep the records for the duration of the support and then for a maximum of three years, unless a longer statutory retention obligation applies.<\/p>\n\n\n\n

        The InBody measurement takes place on the premises of the Pregla Medical Institute, Joachim-Karnatz-Allee 47, 10557 Berlin. Measurement results are used only as part of your counselling and are not passed on to third parties without your consent.<\/p>\n\n\n\n

        12. AI assistant \u201cMia\u201d (chat)<\/h2>\n\n\n\n

        On our website you can ask questions to our AI-powered chat assistant \u201cMia\u201d. The answers are generated automatically by a language model and may be inaccurate; they do not replace personal counselling.<\/p>\n\n\n\n

        Your chat messages are transmitted to our chat server, operated by Railway Corporation, USA, and from there to OpenAI (OpenAI Ireland Ltd., 1st Floor, The Liffey Trust Centre, 117\u2013126 Sheriff Street Upper, Dublin 1, Ireland, or OpenAI, L.L.C., USA) to generate the answer. We have data processing agreements with both providers; transfers to the USA are based on the EU-US Data Privacy Framework or the European Commission\u2019s standard contractual clauses. Under OpenAI\u2019s contractual terms, content submitted via the interface is not used to train the models. In addition, the conversation is stored only for the duration of the browser session in your browser\u2019s session storage.<\/p>\n\n\n\n

        Please do not enter health data or other sensitive information in the chat. Use of the chat is voluntary.<\/p>\n\n\n\n

        Legal basis: Art. 6(1)(f) GDPR (answering questions about our offer) or Art. 6(1)(b) GDPR where your question relates to an order or counselling.<\/p>\n\n\n\n

        13. Google analytics and marketing services<\/h2>\n\n\n\n

        The provider of the following services is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Data may be transferred to Google LLC in the USA; Google is certified under the EU-US Data Privacy Framework.<\/p>\n\n\n\n

        Google Consent Mode:<\/strong> Google Analytics and Google Ads are only used in full, with cookies, if you have consented via the cookie banner (Art. 6(1)(a) GDPR, \u00a7 25(1) TDDDG). As long as you have not consented or have declined, no cookies are set and no information is stored on or read from your device. In this case Google only receives cookieless signals without a persistent identifier (e.g. time of the page view, page viewed, browser and device type, your consent setting and your IP address, which according to Google is used only to determine the approximate location and is not stored). Google uses these signals to model the reach of our website and the success of our ads statistically in aggregated form. The legal basis is our legitimate interest in privacy-friendly reach measurement (Art. 6(1)(f) GDPR). You can object to this processing at any time (Art. 21 GDPR), e.g. by sending an informal message to info@bezugla.de or by using browser extensions that block tracking.<\/p>\n\n\n\n

        Google Tag Manager<\/h3>\n\n\n\n

        Google Tag Manager is a tool we use to integrate and control the other Google services on the website. It does not set cookies or analyse usage data itself, but it processes your IP address when it loads.<\/p>\n\n\n\n

        Google Analytics 4<\/h3>\n\n\n\n

        Google Analytics 4 creates pseudonymous reports on how our website is used (e.g. pages viewed, time spent, origin, device type, approximate location, checkout steps in the shop). IP addresses are shortened by Google within the EU and not stored. The data is deleted after 14 months at the latest.<\/p>\n\n\n\n

        Google Ads conversion tracking and remarketing<\/h3>\n\n\n\n

        We run ads via Google Ads and measure whether a visit via an ad led to an order (conversion tracking). For this purpose, a cookie is set when you click on an ad. With enhanced conversions, your email address may also be transmitted to Google in encrypted (hashed) form to improve measurement. We may also show relevant ads on Google to users who have visited our website (remarketing).<\/p>\n\n\n\n

        Google Maps (link)<\/h3>\n\n\n\n

        On our contact page we link to our location on Google Maps. No map is embedded automatically; data is only transmitted to Google when you click the link and open the Google Maps website. Google\u2019s privacy policy applies there.<\/p>\n\n\n\n

        14. Email marketing and customer reviews<\/h2>\n\n\n\n

        Tips and offers by email<\/h3>\n\n\n\n

        If you tick the box \u201cYes, I would like to occasionally receive useful tips and offers by email\u201d during checkout, we use your email address and name to occasionally send you information about nutrition, prevention, our products and counselling services. As proof, we store your consent together with the time it was given with your order. Participation is voluntary and not a condition for ordering.<\/p>\n\n\n\n

        The legal basis is your consent (Art. 6(1)(a) GDPR, \u00a7 7(2) no. 2 UWG). You can withdraw your consent at any time with effect for the future, e.g. via the unsubscribe link in every email or by message to info@bezugla.de. After withdrawal, we remove your address from the mailing list; we continue to document the consent itself insofar as this is necessary as proof (Art. 6(1)(c) and (f) GDPR).<\/p>\n\n\n\n

        Request for a product review<\/h3>\n\n\n\n

        With your consent, which you can give during checkout via a separate checkbox, we send you an email a few days after your order is completed asking you to review the products you bought, and possibly a reminder. For this we use the WordPress plugin \u201cCustomer Reviews for WooCommerce\u201d; the emails are sent via our own website, and your data is not transmitted to the plugin provider. If you submit a review, it is published on our website with your first name or the name you provide. The legal basis is Art. 6(1)(a) GDPR; you can withdraw your consent at any time, e.g. by message to info@bezugla.de.<\/p>\n\n\n\n

        15. Fonts<\/h2>\n\n\n\n

        The fonts used on our website are loaded locally from our server. No connection to Google Fonts or other font providers is established for this.<\/p>\n\n\n\n

        16. Recipients outside the EU<\/h2>\n\n\n\n

        Where we transfer data to recipients outside the EU or EEA (hosting in Ukraine and individual service providers in the USA), we only do so if there is an adequacy decision of the European Commission (e.g. the EU-US Data Privacy Framework) or appropriate safeguards under Art. 46 GDPR, in particular standard contractual clauses, have been agreed.<\/p>\n\n\n\n

        17. Storage period<\/h2>\n\n\n\n

        We only store personal data for as long as necessary for the respective purpose. We retain contract and invoice data in accordance with statutory retention periods (up to 10 years under \u00a7 147 AO and \u00a7 257 HGB). Data based on consent is deleted after consent is withdrawn, unless another legal basis applies.<\/p>\n\n\n\n

        18. Your rights<\/h2>\n\n\n\n
